Miami-Dade County Ordinance 260593 creates Section 33-39.5 of the County Code, establishing procedures for the administrative acceptance and approval of covenants related to the Live Local Act. This ordinance applies to proposed developments within Transit-Oriented Developments (TODs) or designated areas. It allows for administrative approval of covenants that specify development parameters such as maximum height, density, floor area ratio, and parking, which may differ from statutory requirements, provided these agreements are made between the applicant and the County. Modifications to these covenants can also be handled administratively, unless they do not meet administrative standards, in which case they require approval by the Board of County Commissioners after a public hearing.
