This ordinance relates to the Miami-Dade County Comprehensive Development Master Plan (CDMP) amendment application CDMP20230013, filed by Kelly Tractor Company. The project is located west of NW 137 Avenue and SR-836 Interchange, and north side of theoretical NW 6 Street, encompassing approximately 246.07 acres. The applicant initially sought to redesignate the land use map from 'Open Land' and 'Industrial and Office' to 'Terminals' and 'Industrial and Office', and expand the Urban Expansion Area. However, the application was revised to amend the 'Open Land Subarea 3' land use category text to create the 'MIA Equipment and Supportive Services Area', add a proffered Declaration of Restrictions, and amend the CDMP Capital Improvements Element. The application was adopted on first reading on 7/17/2025. It was subsequently vetoed by the Mayor on 2/1/2026. The Board of County Commissioners reconsidered the item on 1/22/2026, adopting it with changes and assigning Ordinance No. 26-4, but this was later vetoed. The item was deferred multiple times, with the latest deferral to the June 2, 2026 Board meeting. The final action taken was 'ADOPT AS TRANSMITTED WITH FURTHER CHANGES' with acceptance of a revised Declaration of Restrictions and specific conditions, including the submission of executed documents within 10 days, otherwise the application would be deemed withdrawn. Further changes included revisions to the proposed text and the Covenant, such as requiring accessory uses to be consistent with the CDMP, mandating an Administrative Site Plan Review, requiring NW/SW 139 Avenue to be open to traffic prior to the first temporary certificate of occupancy, specifying wetland mitigation requirements, and committing to provide and maintain a wildlife habitat corridor connection.
