[SWC Dairy Road & U.S. Highway 1; case CUP No. 9-2025] The Planning and Zoning Commission is considering a Conditional Use Permit (CUP) No. 9-2025 for a convenience store with fuel pumps. The project is located on a 2.64-acre portion of a 14.70-acre parcel at the southwest corner of Dairy Road and North U.S. Highway 1. The proposed store is approximately 4,853 square feet with 14 fueling stations. The applicant, Chalav LLC, represented by Nathan Landers, has revised the concept plan to address previous concerns regarding pedestrian and bicyclist safety along the Coast-to-Coast Trail. The revised plan utilizes an existing shared driveway to the south for access, avoiding a new trail crossing. Staff recommends approval. The item was previously reviewed and recommended for denial by the Commission on January 21, 2026, due to trail conflict concerns, and was withdrawn from City Council agenda on February 24, 2026, for revisions. The item is scheduled for City Council review on July 14, 2026. The Planning and Zoning Commission meeting is scheduled for June 17, 2026, where the item was tabled from the June 3, 2026 meeting.
