The ordinance aims to regulate certified recovery residences. The Commission debated the application process, distance requirements, enforcement, and certification entities. After initial deliberation and a failed motion to deny, a motion to recommend approval with 11 specific conditions passed. These conditions include adding an application fee, graduated distance based on occupants, addressing inspections, requiring specific documentation, identifying certifying entities and accreditation levels, detailing services and operating hours, clarifying appeal processes, and including automatic revocation for violations. Member Fayson voted no, stating the policy should mirror that of other group homes. The Planning and Zoning Commission received a recommendation from staff to investigate the issue of density as it relates to Section 34-347 (Nonconforming lots). The goal is to ensure that if a lot becomes non-conforming due to a zoning district's density standard, it is eligible for the remedies in that section without requiring a variance. Member Garrod made the motion, and Member Troutman seconded it. The Commission's recommendation is to advise City Council to have staff investigate this matter.
