Public Hearing to vacate 1.10 acres, more or less, of right-of-way dedicated to the City of Kissimmee to be used as a future roadway along the west portion of a 10.87 acre parcel located north of Oak Street, West of Michigan Avenue, and south of E. Vine Street, that is zoned Mixed-Use Urban Corridor (T5-U). The subject property is developed as a multifamily residential development (DRC-19-00180), with 256 apartment units, an amenity center, and associated parking. The subject right-of-way is approximately 47 feet wide and 1,024 feet long and extends along the eastern portion of the property running from north to south. The proposed right-of-way vacation is necessary to eliminate an existing right-of-way dedication that is located within the parking area associated with the multifamily residential development. The Development Review Committee (DRC) recommended approval on April 7, 2026, subject to conditions. Requested Planning Advisory Board action: Approve w/Conditions. No objections to the proposed right-of-way vacation were received from any utility providers. Toho Water Authority has secured a utility recorded easement over the proposed right-of-way dedication. Conditions: 1. This right-of-way vacation is subject to utility provider(s) or other public agency approvals and conditions, in addition to City Attorney, City Engineer, City Surveyor, and City Commission approvals. 2. Toho has no objections to the abandonment of this easement. Utilities that are within the development have a recorded easement and will continue to require a utility easement dedicated to Toho Water Authority. Charter (Spectrum) representative Dwayne Leachman stated via email that they should not have any facilities in the tree line highlighted on the map, but do have facilities on the parcel next to it.
