This ordinance creates Section 33-39.5 of the Miami-Dade County Code, establishing procedures for the administrative acceptance and approval of covenants related to the Live Local Act. These covenants apply to proposed developments within Transit-Oriented Developments (TODs) or designated areas. The ordinance allows for administrative approval of covenants that specify maximum height, density, floor area ratio, and parking requirements, even if the property is not currently eligible for Live Local Act development or regardless of its current zoning. Modifications to these covenants can also be processed administratively, unless they do not meet specific criteria, in which case they require approval by the Board of County Commissioners after a public hearing. The ordinance was amended and forwarded to the Board of County Commissioners with a favorable recommendation by the Transportation Committee following a public hearing where no one appeared to speak. It was adopted on first reading by the Board of County Commissioners.
