This ordinance implements recommendations from the Special Task Force to Reduce Inefficiencies in Procurement. Key changes include standardizing Small Business Enterprise (SBE) utilization percentages for architecture and engineering task-based contracts at 10% and defined-scope contracts at 15%, eliminating the Small Business Enterprise Advisory Boards and Project Review Analysis Committees, and introducing an automatic SBE set-aside for Invitations to Quote under $250,000 when a certified small business bid is within 10% of the lowest non-SBE bid. It also modifies local business preference policies, clarifies verification of Local Business Preference eligibility, and mandates audits for local preference claims. New criteria for Locally Headquartered Business status require over 50% of full-time employees to work in Miami-Dade County, and that Miami-Dade County be the sole claimed local headquarters. The ordinance also allows special purpose entities created by local businesses to receive Local Preference and sets ownership requirements for business entities with non-local partners to qualify for Local Preference. Remedies for non-compliance with SBE utilization plans will be available during active contract performance, not just for future contracts. The ordinance amends sections 2-10.4.01, 2-8.1.1.1.1, 2-8.1.1.1.2, and 2-8.5 of the Code of Miami-Dade County.
