Resolution ratifying Emergency Contract No. E-10663, MDPLS Microsoft Licenses, to Insight Public Sector, Inc. in the amount of $1,700,000.00 for a three-year term for the Communications, Information and Technology Department on behalf of the Miami-Dade Public Library System. The contract was adopted by the Board of County Commissioners on 7/21/2026. The emergency was declared by the CITD Director on January 15, 2026. The contract expires on January 14, 2029. The vendor is Insight Public Sector, Inc., located at 2701 E Insight Way, Chandler, AZ. The reason for the emergency is Microsoft's transition from its Educational Licensing Program to its Nonprofit Licensing Program, which eliminated MDPLS's eligibility for educational discounted pricing. A competitive solicitation, EVN0027540, was advertised on September 19, 2025, but was cancelled after Microsoft advised that proceeding through a CSP would jeopardize eligibility for nonprofit discounted pricing. The County attempted to negotiate a direct agreement with Microsoft, but Microsoft refused to accept State of Florida mandated requirements. Staff conducted outreach with peer institutions including Broward Public Library, King County Library System, Urban Libraries Council, American Library Association, and the Florida Department of State Division of Library and Information Services, which reported similar difficulties. The contract includes a two percent User Access Program. The Small Business Enterprise measures, Local Preference, and Living Wage Ordinance do not apply. Due diligence found no adverse findings relating to vendor responsibility.
